According to the report by Leadership, Fintiri was cleared by
PDP’s appeal panel on Sunday and would be able to contest in the party’s
primary elections scheduled for September 6, 2014, Saturday.
Commenting on the first decision, the leader of screening committee Ibrahim Mantu referred to Section 191 (2) of the Constitution 1999. He said that the decision to disqualify Fintiri was base on the fact that his duty as the acting governor was to ensure the conduct of hitch-free elections, and not to take part in the race.
However, James Manager, the leader of 13-member appeal panel, announced that Fintiri was cleared, as the position of Mantu-led committee was not right, because “the provisions of the constitutions does not affect the applicant.”

“We are issuing a provisional clearance to the applicant. Almost
all of us are meeting the acting governor for the first time and the
decision to clear him was taken based on what was before us,” the head of appeal member concluded.
In his earlier comments Fintiri expressed dissatisfaction with the initial decision. But he did not give up, saying “I think they (the panel) will do justice to what I have come to ask from them.”
It would be noted that the winner of primaries will bear the flag of Nigeria’s ruling party on October 11, when before-term governorship election takes place. The polls become possible following the impeachment of Governor Murtala Nyako by the State House on July 15, 2014.
The battle between PDP candidates will be fierce and intense, as Awwal Tukur, Ahmed Gulak, Nuhu Ribadu and nine others have collected PDP’s nomination for upcoming elections.
